JOURNEY TOWARDS A DREAM HOME FOR EACH AND EVERY MEMBER
- UP AVAS EVAM VIKAS PARISHD (UPAVP), through notification dated 28-11-1998 published in national news papers, notified land acquisition for their SIDHARTH VIHAR PARIYOJNA. This included the land of all societies in the area including URDAS.
- URDAS represented to UPAVP not to acquire our land , but to include our society in the scheme and hand over developed plots after charging development charges.
- UP GOVT had issued detailed guidelines for amalgamation of land owned by registered housing societies. Accordingly all the societies within the scheme areas were invited to submit their details. After the scrutiny, the local office recommended amalgamation of our society in the scheme.
- In the meantime UPAVP announced auction of large size plots to Builders . One Plot which included URDAS land was allotted to M/S Prateek Realtors India Pvt Ltd. URDAS filed a writ petition in Allahabad High court.
- High court directed the Chairman UPAVP to consider URDAS claim and give suitable response to our petition.
- Chairman UPAVP confirmed that URDAS land is to be amalgamated in Sidharth Vihar scheme. But there is dispute as the land available is less than that claimed by three societies. Hence amalgamation can not carried out until the title ownership of land and its measurement are notified by the Revenue department of Gaziabad .
- As per UP GOVT G.O. No4128/9-A-3-2000-2LA/92(AB) Dated 22 October 2002 maximum upto 50% of the land of the society would be allotted to the society, on payment of amalgamation, development and other charges. This land if devided into the plots , after leaving further 33% of the allotted for roads and parks etc. will result in 28 sq mtr for 100 yard members, 40 sq mtr for 150 yard members and 56 sq mtr for 200 yard members. It was estimated that more than 35 crores will have to be paid to UPAVP towards amalgamation, development and other charges.
- It was, therefore, proposed to take help from an influential builder , first- to get the land allotted by revenue department and UPAVP , second - to plan and build multistoried flats for the members without any more cost to the members. This proposal was approved by members in the AGM held on 14-12-2014.
- A consortium agreement was entered into with Mr Ankush Tyagi of TAND T INFRAZONE PVT LTD for this purpose.
- Consortium agreement provided one flat to each member of the sizes as under:
- 1) 100 sq yds Members - 900-950 Sq Ft (Two Bed Room)
- 2) 150 sq yds Members -1350-1400 Sq Ft (Three Bed Room)
- 3) 200 Sq yds Members -1800-1900 Sq Ft ( Four Bed Room)
- Due to constant efforts made by URDAS and Builder jointly, title of 4.3147 HA of land was confirmed by ADM / Gaziabad . UPAVP allotted 2.049 HA ( 20490 Sq Mtrs) of land to the society in accordance with the UP GOVT guidelines.
- UPAVP Vide their letter No 1635/LAC/HQ/ Dated 17-10-17 confirmed the allotment of plot No 3/SP-03 area 2.049 HA on payment of Rs 5,73,83,200=00 towards development and freehold charges.
- On payment of 25% of the charges by the builder on behalf of URDAS, land was registered in the name of URDAS by UPAVP on 07-06-2017 on Hire-Purchase lease hold basis.
- Plans for construction of multistoried flats on the allotted land submitted by URDAS/BUILDER were approved by UPAVP vide letter no 1871/NI. PR-52/2017/VA.NI-5 dated 30-06-2017
- After clearance of all dues of UPAVP the land was registered in the name of URDAS as sale on freehold lease in perpetuity on 15-03-2019.
- After applying and obtaining NO OBJECTION CERTIFICTES from various authorities the project has been registered with UP RERA by the Builder, under Registration No.- UPRERAPRM51250.
- Joint Development agreement has been entered between URDAS and Builder M/S T & T Infrazone Private Limited for completion of the project within 48 months.
- The work has been started in right earnest at site.
- Project Monitoring Committee has been formed to monitor the progress and quality of the project construction.
